Welcome to mwerre.com.au (the “Website“). These Terms & Conditions (“Terms“) govern your use of the Website and any purchase you make from us. By accessing the Website or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Website.
Business name: Mwerre ABN: [ABN] Email: [email protected]
1. About Mwerre
Mwerre is an Aboriginal-owned skincare brand creating handmade, artisan soap and bath products inspired by Australian native botanicals, clays and landscapes.
Acknowledgement of Country and Cultural Integrity: Mwerre’s products draw on Australian Indigenous ingredients, colours and stories that hold cultural significance. All product names, descriptions, and imagery referencing Indigenous culture, Country, or native ingredients are used respectfully and with the authority of Mwerre’s Aboriginal ownership. Nothing in these Terms transfers any Indigenous Cultural and Intellectual Property (ICIP) rights to customers, and no part of our branding, product design, or content may be reproduced, adapted, or used commercially without our prior written consent.
2. Eligibility and Website Use
You must be at least 18 years old, or have the consent of a parent/guardian, to place an order on this Website. You agree to use the Website only for lawful purposes and not to:
- Use the Website in any way that could damage, disable, or impair it
- Attempt to gain unauthorised access to any part of the Website or our systems
- Copy, reproduce, or exploit any content from the Website without permission
- Submit false, misleading, or fraudulent information when placing an order
3. Products
- Many of Mwerre’s products are handmade and small-batch. As a result, colour, shape, texture, weight, and scent may vary slightly between batches and individual items — this is a natural feature of handcrafted products, not a defect.
- We make reasonable efforts to display product colours and images accurately, but slight variation between what’s shown on screen and the physical product may occur due to photography, lighting, and screen brands and settings.
- Ingredients and allergies: Product ingredients are listed on individual product pages. It is your responsibility to review ingredient lists before purchase, particularly if you have allergies or sensitive skin. We recommend performing a patch test before first use of any new product.
- Our products are intended for external use only, are not a substitute for medical advice or treatment, and should not be used on broken or irritated skin. If irritation occurs, discontinue use and seek medical advice.
- Product availability is subject to change without notice. We reserve the right to discontinue, modify, or limit the availability of any product at any time.
4. Pricing and Currency
- All prices are listed in Australian Dollars (AUD) unless otherwise selected. Where the Website displays prices in other currencies (e.g. USD, SGD) for browsing convenience, your order will be charged in AUD, converted at checkout by our payment processor and the final amount charged may vary slightly due to currency conversion and exchange rates applied by your bank or card provider.
- We take reasonable care to ensure prices are accurate, but errors may occur. If a pricing error is identified, we reserve the right to cancel the order and issue a full refund, and will notify you before processing.
- Prices are inclusive of GST for Australian orders, where applicable, and exclusive of shipping costs unless stated otherwise.
5. Orders and Acceptance
- Placing an order constitutes an offer to purchase, which we may accept or decline at our discretion (for example, in cases of suspected fraud, pricing errors, or stock unavailability).
- A contract of sale is only formed once we send you an order confirmation email. We will notify you if any part of your order cannot be fulfilled or cannot be fulfilled in a reasonable time period.
- You are responsible for ensuring your order and delivery details are accurate at the time of purchase.
6. Payment
- Payment is required in full at the time of order via the payment methods available at checkout (e.g. credit/debit card, PayPal, Afterpay).
- Payments are processed securely through third-party payment providers. We do not store your full payment card details.
- We reserve the right to refuse or cancel any order where payment cannot be verified or processed.
7. Shipping and Delivery
Shipping costs, timeframes, and delivery areas are set out in our Shipping Policy. By placing an order, you agree to the terms of that policy, including:
- Estimated delivery timeframes are not guaranteed and may be affected by factors outside our control (e.g. courier delays, extreme weather, public holidays).
- Risk in the goods passes to you upon delivery to the address provided.
- International orders: Customers outside Australia are responsible for any customs duties, import taxes, or clearance fees imposed by the destination country. These are not included in the product price or shipping cost.
8. Returns, Refunds and Consumer Guarantees
Our returns and refunds process is set out in our Return & Refund Policy.
Nothing in these Terms or our Return & Refund Policy excludes, restricts, or modifies any rights or remedies you have under the Australian Consumer Law (ACL). Under the ACL, our products come with guarantees that cannot be excluded, including that they are of acceptable quality, fit for purpose, and match their description. If a product fails to meet a consumer guarantee, you are entitled to a repair, replacement, or refund, depending on the nature of the issue and the product.
Due to hygiene reasons, we generally cannot accept returns of used soap or bath products unless the item is faulty, not as described, or does not meet a consumer guarantee under the ACL.
9. Wholesale, Corporate and Hospitality Orders
Separate terms, minimum order quantities, and pricing may apply to wholesale, corporate gifting, and hospitality (guest soap) orders. These will be confirmed directly with you in writing (e.g. via quote or invoice) and, where they differ from these Terms, the specific terms agreed with you in writing will prevail for that order. Bulk Orders, manual orders or orders that are invoiced may not attract the same product price as the website price listing due to updated pricing for new stock orders.
10. Accounts
If you create an account on the Website, you are responsible for maintaining the confidentiality of your login details and for all activity under your account. Notify us immediately if you suspect unauthorised use of your account.
11. Intellectual Property
All content on the Website — including text, images, logos, product designs, and the Mwerre brand name and trademarks — is owned by or licensed to Mwerre and is protected by Australian and international intellectual property law. You may not reproduce, distribute, or use this content for commercial purposes without our prior written consent.
12. Reviews and User Content
If you submit a product review, comment, or other content to the Website (e.g. via reviews or social media tagging), you grant Mwerre a non-exclusive, royalty-free licence to use, reproduce, and display that content for marketing purposes. You must not submit content that is false, defamatory, offensive, or infringes the rights of any third party. We reserve the right to remove any user-submitted content at our discretion.
13. Limitation of Liability
To the maximum extent permitted by law, and subject to your non-excludable rights under the Australian Consumer Law:
- Mwerre’s total liability for any claim arising from your use of the Website or purchase of products is limited, at our option, to the resupply of the product or the refund of the amount paid.
- We are not liable for any indirect, incidental, or consequential loss arising from your use of the Website or our products, including loss of profits, data, or business opportunity.
- We do not guarantee that the Website will be uninterrupted, error-free, or free from viruses or harmful components.
Nothing in this section limits liability that cannot lawfully be limited or excluded, including liability under the Australian Consumer Law for failure to meet a consumer guarantee.
14. Indemnity
You agree to indemnify and hold Mwerre harmless from any claim, loss, or damage arising from your breach of these Terms or misuse of the Website, except to the extent caused by our own negligence or breach of law.
15. Third-Party Links
The Website may contain links to third-party websites (including social media platforms). We are not responsible for the content, accuracy, or privacy practices of those third-party sites.
16. Privacy

17. Changes to These Terms
We may update these Terms from time to time. The updated version will be posted on this page with a revised “Last updated” date. Continued use of the Website after changes take effect constitutes acceptance of the updated Terms. Orders placed before a change took effect will be governed by the Terms in place at the time of the order.
18. Governing Law
These Terms are governed by the laws of Victoria, Australia. You submit to the non-exclusive jurisdiction of the courts of Victoria, Australia for any disputes arising from these Terms.
19. Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision will be severed, and the remaining provisions will continue in full force and effect.
